Terms of Membership

Article 1 [Purpose)

These Terms and Conditions are governed by the terms and conditions of use of the website ("Hanultari", www.mcfamily.or.kr) provided by Seoul Metropolitan Government and Yeongdeungpo-gu Multicultural Family Support Center defining the rights, duties, responsibilities and other necessary matters with the user

Article 2 (Definitions)

Terms used in these provisions are defined as follows.
* "User" means a person who accesses the Center's "Hanultari" and concludes a contract with the Center in accordance with the Terms and Conditions of "Hanultari" provided by the Center.
* "ID" means the combination of letters and numbers made by "User" for the identification of "User" and "Hanultari" and approved by "Hanultari".
* "Password" means the combination of numbers and letters given by the "User" in accordance with the "ID" made by the "User"
* "Post" means that if the "user" uses the "Hanultari", the “user” has an access of the "information" such as code, text, voice, sound, image, photos, videos, links to various files and links.

Article 3 (Publication and Amendment of Terms)

1. The "Center" will post the contents of this Agreement on the initial screen of the Service so that the "User" can easily understand.
2. The "Center" shall not be in violation of applicable laws, such as the "Law on Regulation of Terms," ​​"Act on Promotion of Information Network Usage and Information Protection, etc." (hereinafter referred to as “Information and Communication Network Act”)
3. If the "Center" amends the Terms and Conditions, the applicable date and reason for the revision shall be specified, together with the existing terms and conditions, from 30 days prior to the effective date of the amendment.
Notice will be given the day before the application date. However, in the case of amendment of the terms unfavorable to the user, it may be possible to use e-mail in Hanultari for a certain period of time,
We will notify you clearly through electronic means.
4. If the Center notifies the user of the amendment in accordance with the preceding paragraph and the user does not give any indication within the 30-day period, it means, the user agrees to the Terms.
If you do not express your intention to deny even though you have been clearly notified, it means you consent to the revised terms.
5. If the user does not agree with the application of the revised Terms, the Center can not apply the contents of the revised Terms. In such case, the User may terminate the contract. However, if there is any special circumstance where the existing terms can not be applied, the Center may terminate the contract.

Article 4 (Interpretation of Terms)

1. The "Center" may have separate terms and policies for individual services, and if the content conflicts with these terms, the separate terms and policies are being applied.
2. Unless otherwise stated in these Terms and Conditions, the terms and conditions of use and interpretation shall be in accordance with the separate terms and conditions and policies and related laws and practices.

Article 5 (Contract of Use)

1. The contract of use shall be such that the person who intends to become a "user" (hereinafter referred to as "the applicant") agrees with the contents of the agreement and applies for membership, and the "center" as concluded by consent.
2. The "Center" shall, in principle, approve the use of "Hanultari" for the application of the "applicant for membership". However, the "Center" shall not be used for applications falling under any of the following:
You can not accept or cancel the contract after the expiration date.
If the applicant has previously lost his / her membership in accordance with the terms of this agreement, except when he / she obtains the approval of re-entry of the user of the "center".
If the name is not a real name or someone else's name is used
▨ In case of false information or the contents of the "Center" are not listed.
▨ When the user is unable to approve due to reasons of his / her reasons or if
▨he / she violates other prescribed matters
3. In the case of application under Paragraph 1, the "Center" may ask for verification of the real name and authentication of the person through the specialized agency according to the type of "user".
4. "User" may waive the consent in case there is no room for service related facilities, technical or business problems.
5. If you do not accept or reserve the application for membership pursuant to Paragraphs 2 and 4, the "User" will, in principle, notify the applicant of the application.
6. The time of establishment of the contract of use shall be the time when "Center" indicates the completion of the application in the application procedure.
7. The "Center" may be divided into classes according to the center policy for "users", and the usage time, number of uses, service menu, etc. may be divided into different types.

Article 6 (Change of Member’s Information)

1. "User" can view and modify his / her personal information at any time through the personal information management screen.
However, it is not possible to modify the real name, ID, etc. required for service management.
2. The "User" shall notify the "Center" by e-mail or other means, The user directly informs the Center of the change.
3. The Center will not be held responsible for any disadvantages caused by not notifying the Center of changes made in Paragraph 2 above.

Article 7 (Obligation to protect personal information)

The "Center" strives to protect the "user"'s personal information as stipulated by related laws such as "Information and Communication Network Act".
The protection and use of personal information will be governed by the relevant laws and the "Privacy Policy" of the Center.
However, in case of linked sites other than "Hanultari", the "Center"'s privacy policy does not apply.

Article 8 (Obligation to Manage "User" and "Password" of "User")

1. The responsibility for the management of the "User" s "ID" and "Password" belongs to the "User" and should not be used by any third party.
2. The "Center" means that if the "User" is concerned about the leakage of personal information, or is in antisocial or mysterious circumstances, or is mistaken as an operator of "Hanultari"
The user may restrict the use of the "ID".
3. The "User" shall promptly notify the "Center" if the "ID" and "Password" are stolen or used by a third party and shall follow the instructions of the "Center".
4. In the case of Paragraph 3, even if the "User" does not notify the Center or notifies the Center of the disadvantage caused by not following the instructions of the Center, the "Company" is not responsible.

Article 9 (Notice to "User")

1. The "Center" shall not engage in acts contrary to the relevant laws and the terms of this agreement or against the moral and the sincerity, and we will do our best to provide "services" continuously and reliably.
2. The "Center" makes every effort to protect personal information so that the "user" can safely use "Hanultari", discloses and obeys privacy policy.
3. The Center has the necessary personnel and systems to properly handle user complaints that arise in connection with the use of the Services.
4. The "Center" shall deal with any comments or complaints raised by the "User" in connection with the use of the Service, if it deems it fair on the part of the "User".
For comments or complaints, we use the bulletin board or send e-mails to process the results and the results to the "user".

Article 10 (Obligations of the "Center")

1. The "Center" shall not engage in acts contrary to the relevant laws and the terms of this agreement or against the moral and the sincerity, and we will do our best to provide "services" continuously and reliably.

Article 11 (Obligations of "User")

▨ The user shall not use "Hanultari" for commercial purposes without the consent of the center
▨ The user shall not do other illegal or unlawful acts
2. The "User" shall comply with the relevant laws, the provisions of these Terms and Conditions, the Notice of Use, and the user shall not engage in activities that interfere with the work of other "companies".

Article 12 (Provision of Services, etc.)

1. The Company provides the following services to its members.

 All services provided by the "Center" to the "user" through additional development or partnership agreements with other companies
2. The Center may divide the "Service" into a certain range and specify the available time for each range separately. However, in such cases, the contents shall be announced in advance.
3. The "Service" is provided 24 hours a day, seven days a week.
4. The "Center" shall not be responsible for temporarily inspecting, replacing or malfunctioning of information and communication equipment such as computers. In this case, the "Center" notifies the "User" in the manner specified in Article 9 [Notice to User "].
However, if there is any unavoidable reason that the Center can not notify in advance, the user can notify the Center after that.
5. The "Center" may carry out periodic inspections if necessary for the provision of services, and the periodic inspections shall follow the instructions posted on the service provision screen.

Article 13 (Change of "Service")

1. The "Center" may change all or some of the "Services" provided for its operational and technical needs, if for any reason.
2. In the event that there is a change in the contents, usage method, or use time of the "Service", the reason for the change, the content of the service to be changed, the user must post it on the initial screen of the service before the change.

Article 14 (Provision of Information and Publication of Advertisements)

1. The "Center" may provide the "user" with various information that the "user" considers necessary during the use of Hanultari by means of notices or e-mail.
However, the "User" may refuse to accept e-mail at any time.
2. The "Center" may display advertisements on the service screen, homepage, e-mail, etc. in connection with the operation of "Hanultari". If the user received an email with ads, the "User" may deny the "Center".
3. The "User" does not take any action to change, modify, limit, or otherwise modify any posts or other information related to the services provided by the Center.

Article 15 (Copyright of "Post")

1. The copyright of the "post" posted by "User" in "Hanultari" belongs to the author of the post.
2. The "Posts" posted by "User" in "Hanultari" may be exposed to search results or "services" and related promotions,
Within the scope, some modifications, duplicates, edits, and publications can be made. In this case, the Center shall comply with the copyright laws, and the "User". The "Hanultari" management function allows the user to take action on such posts, such as deleting, excluding search results, and making them private.
3. In the event that the "Center" is to use the "post" of the "User" in a manner other than Paragraph 2, the "Center" must obtain the consent of the User.

Article 16 (Management of "Posts")

1. If the "post" of the "user" includes contents that are in violation of relevant laws such as "Information and Communication Network Act" and "Copyright Act", the right holder may ask for the posting and deletion of the "post", and the "center" should take action according to the relevant laws.
2. The "Center" means that, even if there is no request by the right holder pursuant to the preceding paragraph, if there is any reason for the infringement to be recognized or other breach of the center policy and related laws, the user can then take temporary measures against such "posts".
3. The detailed procedures under this section shall be subject to the cancellation request set forth by the Center within the scope of the "Information and Communications Network Act" and "Copyright Act".

Article 17 (Ownership of Rights)

1. The copyright and intellectual property rights to "Hanultari" belong to the "Center". However, if the "post" of the "user" and the works provided under the affiliation agreement are excluded.
2. The "Center" only grants to the "User" a right to use the account, "ID", content, etc., in accordance with the terms and conditions set forth by the Center,
The "User" shall not engage in any disposition such as transfer, sale, or collateral.

Article 18 (Termination, deletion, etc.)

1. The "User" can apply for termination of use contract at any time through the Customer Center or My Information Management Menu at the bottom of the Hanultari screen, the "Center" shall deal with it promptly as stipulated by applicable law.
2. In the event of termination of the Agreement by the User, except in the case where the Center retains the Member Information in accordance with applicable law and privacy policies, all data of "User" will be terminated.
3. In the event that the "User" terminates the contract, any post created by "User" will be deleted.

Article 19 (Restrictions on Use, etc.)

1. The "Center" shall mean, in the event that the "User" violates the obligations of this Agreement or interferes with the normal operation of the "Hanultari", such as by warning, the user may limit the use of the Services in a phased manner.
2. The Center may restrict the use of the user’s information for the protection and effective operation of your membership information if the user does not continue to log in.
3. The "Center" is subject to the terms and conditions set forth in the Usage Restriction Policy and the Operational Policies under the individual Services within the terms of use of this Section.
4. In the event of restricting or terminating the use of a "Hanultari" pursuant to this Article, the "Center" will notify the user in accordance with Article 9 [Notice to "User"].
5. The "User" may file an appeal in accordance with the procedures set forth by the "Center" in relation to the restrictions on use under this section. If the Center considers that the objection is justified at this time
"Center" immediately resumes "Hanultari".

Article 20 (Limitation of Liability)

1. The "Center" has the responsibility on the "Service" that it provides.
2. The "Center" shall prevent any obstacle to the use of the "Hanultari" due to the reasons of the User.
3. The "Center" shall endorse the reliability, responsibility and liability of the information, data and facts relating to "Hanultari".
4. The responsibility is between the "Center" and the "User" and if it used by "Other User" and the center does not assume such responsibility.
5. The "Center" provides the use of the services free of charge and exceptions to the relevant laws and regulations.

Article 21 (Governing Law and Judgment)

1. Any lawsuit filed between the "Center" and the "User" shall be governed by the laws of the Republic of Korea.
2. In case of a dispute arising between the "Center" and the "User", the court having jurisdiction over the location of the education welfare officer shall be the competent court.

Addendum

These terms will be effective starting April 19, 2014.

Consent to Collection and Use of Personal Information (Mandatory)

All personal information handled by the Seoul Family Center shall be collected, retained, and processed in compliance with the personal information protection regulations under relevant laws, such as Article 3 of the Personal Information Protection Act. The Seoul Family Center (hereinafter referred to as "Seoul Center") operates the following processing policies to protect users' personal information and rights and interests in accordance with the Personal Information Protection Act and to smoothly handle users' complaints related to personal information. This Privacy Policy shall apply from the effective date, and the terms are added, deleted, or changed due to the amendment of relevant laws and policies, it shall be announced through the notice on the website.

Article 1 (Purpose of Processing Personal Information, Retention Period, and Security Measures)
1. Purpose of processing personal information

“Seoul Center” collects minimum personal information for the purpose of performing its duties and handling civil complaints, and posts the information on the relevant website operated by each department to be able to be checked by the information subject.
A. B. Volunteer management: Personal information is processed necessary for the Volunteer Management Center's tasks, such as volunteer recruitment, training, placement, and VMS registration information management (volunteer activity contents and performance, certificate issuance).
C. Operation of Steering Committee and Consulting Committee: Personal information is processed necessary for the composition and operation of the operating committee and for the operation of the consulting committee for improving the quality of family services in metropolitan institutions in accordance with the operation regulations of the center.
D. Lecturer management: Personal information is processed necessary for the recruitment, selection, payment of honorarium, background checking, etc. of lecturers necessary for the operation of education, counseling, etc.
E. Employee management: Personal information is processed necessary for hiring new employees. Personal information included in the employment contract shall be used for wage payment, welfare provisions, education request, etc. The entry/exit system records employee’s entry and exit information, and the employee's name, department, position, phone number, fax number, e-mail address, etc. are disclosed for business information and business contact.
F. Handling complaints and grievances: Personal information is processed for the purpose of confirming civil complaints, contacting and notifying facts for investigation, and notifying the results of complaints and grievances of users.
G. Website management: Personal information is processed for the purpose of confirming membership intention, identification and certification required for the provision of service, maintaining and managing membership, verifying self-identification according to the implementation of the identity verification system, preventing illegal use of services, confirming the consent of legal guardian when processing personal information of children under the age of 14, handling various notices and notifications, handling grievances, etc.
H. Sponsorship management: Personal information is processed necessary for works such as managing donations and sponsored items, issuing receipts, etc.

2. Processing Personal Information and Retention Period

A. Personal information processed by the "Seoul Center" shall be processed within the scope specified for the purpose of collection and use and shall be implemented in compliance with the retention period set forth by the Personal Information Protection Act and related laws.
B. "Seoul Center" processes and retains personal information within the period of retention and use of personal information according to the law, or within the period of retention and use of personal information agreed upon collecting personal information from the information subject.

3. Security Measures Operated on the Website

Article 2 (Provision of Personal Information to Third Parties)
1. No personal information collected and retained by "Seoul Center" is provided to any third party without the consent of a user except in the following cases:

A. When a separate consent is obtained from the information subject
B. When special provisions in the Act exist or it is inevitable to comply with the obligations under the Act
C. When the information subject or his/her legal guardian is in a state of being unable to express his/her intention or cannot obtain prior consent due to unknown address, etc. which is clearly recognized as necessary for the immediate need for the life, physical well-being, or pecuniary advantage of the information subject or the third party
D. When personal information is provided in which a specific individual cannot be identified for purposes such as statistical writing and academic research
E. When the "Seoul Center"s duties set forth by other laws cannot be performed without using the personal information for other purposes than set forth under this policy or providing it to a third party; the deliberation and resolution by the Protection Committee is required for such usage or provision.
F. When it is necessary to provide the personal information to a foreign government or an international organization for the implementation of treaties or other international agreements
G. When it is necessary to investigate a crime and file and uphold a public prosecution
H. When it is necessary for a court's trial

Article 3 (Matters Concerning Consignment of Personal Information Processing)
1. In principle, "Seoul Center" does not entrust the processing of personal information to others without the user's consent. However, within the scope of the purpose of processing personal information or with the consent of the user, it is necessary to clearly stipulate in the consignment contract: compliance with laws and regulations related to personal information protection; prohibition of providing personal information to any third party; and responsibilities 2. Article 4 (How to Exercise the Rights and Obligations of the Information Subject and Legal Guardian)
1. The information subject may exercise the following rights related to personal information protection at any time.

A. Request to view personal information

D. Request for suspension of processing

2. The exercise of rights under paragraph 1 may be made in writing, e-mail, facsimile (FAX), etc. in accordance with attached Form 8 of the Enforcement Rules of the Personal Information Protection Act, and actions shall be taken without delay for the user's personal information processed by the "Seoul Center". 3. If the information subject requests correction or deletion of errors, etc. of personal information, the relevant personal information cannot be used or provided until the correction or deletion is completed. 4. The exercise of rights pursuant to paragraph 1 shall be submitted through an agent when entrusted by the information subject. In such case, a power of attorney must be submitted in accordance with the attached Form 11 of the Enforcement Rules of the Personal Information Protection Act. 5. Requests for view and suspension of processing of personal information may be restricted according to Article 35 paragraph 4 and Article 37 paragraph 2 of the Personal Information Protection Act. 6. Requests for correction and deletion of personal information cannot be made if the personal information is specified as the subject of collection in other laws and regulations. 7. In the event of request for view, correction and deletion, or suspension of processing according to the rights of the information subject, it must be confirmed whether the person making the request is the information subject or a legitimate agent. The exercise of rights according to the above may be done through an agent, such as the information subject's legal guardian or a person entrusted by the information subject.

Article 5 (Matters Concerning the Installation, Operation, and Refusal of an Automatic Personal Information Collection Device)

Article 6 (Personal Information Disposal Procedure and Method)

3. Term and Method of Disposal

B. In case of records, printed materials, written documents, or other recording media other than the form of electronic files: Destroy the relevant part and physically completely(incineration, crushing, etc.)

Article 7 (Measures to Ensure Safety of Personal Information)
1. "Seoul Center" must take the following technical, managerial, and physical measures to ensure safety.

A. Establish and implement an internal management plan in accordance with the 「Standards for Measures to Ensure Personal Information Security」(Notice of the Ministry of the Interior and Safety).
B. Minimize, designate, and manage the necessary personal information handlers, and provide them with regular education.
C. Control access to personal information by granting, changing, and canceling access rights to the database system that processes personal information, and control unauthorized access from outside using intrusion blocking and prevention systems.
D. Keep and manage the access records to the personal information processing system(web logs, information summary, etc.) for minimum one year.
E. Users' personal information must be encrypted, stored and managed. And also, use separate security functions such as encrypting important data when storing and transmitting.
F. Install and periodically update and inspect security programs to prevent any leakage and damage of personal information by hacking or computer viruses; install the system in an area where physical access is controlled; monitor and block the system technically and physically.

Article 8 (Remedy Method for Infringement of Rights and Interests)
1. The information subject may inquire about damage relief and consultation for personal information infringement to the following institutions. If more detailed help is needed regarding the "Seoul Center"'s own personal information complaint handling and damage relief results, the institutions below may be contacted.

2. A person whose rights or interests have been infringed upon due to a disposition or omission taken by the head of a public institution in response to a request made pursuant to the provisions of the 「Personal Information Protection Act」 Article 35 (View personal information), Article 36 (Correction and deletion of personal information), Article 37 (Suspension of processing of personal information, etc.) may request an administrative trial under the provisions of the Administrative Appeals Act.

Article 9 (Request to View Personal Information)
1. An information subject may request the following departments to view personal information under Article 35 of the Personal Information Protection Act, and "Seoul Center" shall promptly process the request of the information subject.

2. The information subject may request to view personal information through ‘Personal Information Protection Commission’ website of the Ministry of the Interior and Safety, in addition to the "Seoul Center"'s department in charge of receiving and processing requests under the paragraph 1 above.

Article 11 (Installation and Operation of Video Information Processing Devices)
1. The "Seoul Center" installs and operates video information processing devices as follows.

A. Basis and purpose of installation of video information processing devices: For the "Seoul Center"'s facility safety and fire prevention
B. The number and location of installed devices and the recording range: The main facility shall be within the recording range, such as the first and the second floor lobbies; two devices will be installed.
C. Person in charge of management, department in charge, and person with access to video information: General planning team leader
D. Video information recording time, storage period, storage place, processing method
①Recording time: 24-hours
②Storage period: 30 days from the time of recording
③Storage place and processing method: General planning team stores and processes video information
E. How and where to check video information: Request to the person in charge of management(contact number of General Planning Team 02-318-8160, FAX 070-7469-0228)
F. Measures for the Information Subject's Request to Access Video Information: The information subject shall make a request by the Request Form to View and Confirm the Existence of Personal Video Information; Viewing is allowed only when the information subject is recorded or when it is necessary for the immediate need for the information subject's life, physical well being, or pecuniary advantage.
G. Technical, managerial, and physical measures to protect video information: Measures such as establishment of an internal management plan, access control and restriction of access authority, applying safe storage and transmission technology for video information, measures to keep processing records and prevent forgery and falsification, preparation of storage facilities and installation of locking devices, etc.

Article 12 (Change of Personal Information Processing Policy)
1. This personal information processing policy shall apply from 15th of March 2024.
